1. About These Terms

These Terms of Service (“Terms”) govern your access to and use of the AI Growth Engine website, tools, reports, recommendations, and all related services (collectively, the “Service”) operated by AI Growth Engine (“we”, “us”, or “our”). These Terms constitute a legally binding agreement between you (“User”) and us. We reserve the right to update these Terms at any time. Continued use of the Service after any update constitutes acceptance of the revised Terms.

2. Nature of the Service — Informational Only

AI Growth Engine provides automated website analysis, performance scoring, and general digital marketing guidance for informational purposes only. Nothing provided through the Service constitutes professional advice of any kind, including but not limited to legal, financial, technical, SEO, or business advice.

All audit results, scores, recommendations, estimates, projections, and reports generated by the Service are produced by automated systems and third-party APIs. They reflect a point-in-time snapshot of publicly accessible website data and may be incomplete, outdated, or inaccurate. You should independently verify all findings before making any business decision based on them.

3. No Guarantee of Results

We make no representations, warranties, or guarantees — express or implied — that use of the Service or implementation of any recommendations will result in any specific outcome, including but not limited to:

• Improved search engine rankings or Google visibility
• Increased website traffic, leads, or conversions
• Higher revenue or return on investment
• Faster page load times or improved Core Web Vitals scores
• Compliance with any third-party platform requirements

Any revenue estimates, “estimated monthly loss” figures, or projected improvements shown in reports are illustrative examples based on industry averages, not personalised forecasts. Actual results will vary.

4. Accuracy of Audit Data

Audit scores are derived from Google PageSpeed Insights API (Lighthouse) and may differ from scores you see in other tools, at different times, or under different network conditions. We do not control Google's API output, scoring algorithms, or availability. Score results can vary based on:

• Server response time at the moment of the scan
• Third-party scripts or resources on your site
• Geographic location of the testing server
• Temporary caching, CDN, or infrastructure states
• Dynamic content or personalisation on the page

We do not warrant that any audit result is complete, accurate, or fit for any particular purpose. You use all audit data entirely at your own risk.

5. Third-Party Services

The Service relies on third-party providers for core functionality. We do not control their APIs, uptime, security practices, documentation, or terms. Their failures or changes may affect the Service without notice and without liability to you.

Depending on configuration and features you use, processing may involve (among others):

• Google PageSpeed Insights / Lighthouse — audits of URLs you submit.
• Vercel — hosting and infrastructure; in production we may use Vercel Analytics for aggregated usage metrics (see Cookie Policy).
• Resend — transactional email delivery when enabled by us for certain flows.
• Google AI (Gemini) — when you use features that call our AI assistant backend.
• Payment processors — if and when paid services are offered and you choose to purchase.

Your use of the Service constitutes direction for us to engage these providers as reasonably necessary to deliver the Service, subject to the disclosures in our Privacy Policy.

6. Acceptable Use

By using the Service, you agree that you will not:

• Submit URLs you do not own or are not authorised to analyse
• Use the Service to scan, probe, or attack third-party websites
• Attempt to reverse-engineer, scrape, or copy any part of the Service
• Misrepresent your identity or submit false information
• Use the Service for any unlawful, fraudulent, or abusive purpose
• Overload or interfere with our infrastructure through automated requests

We reserve the right to suspend or terminate access for any user who violates these rules, at our sole discretion and without prior notice.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AI GROWTH ENGINE, ITS OWNERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY:

• Indirect, incidental, special, punitive, or consequential damages
• Loss of profits, revenue, data, business, or goodwill
• Damages arising from reliance on any audit result, report, or recommendation
• Damages from inability to access the Service or from service interruption
• Damages caused by third-party services, tools, or APIs used by the platform

Our total aggregate liability to you for any claim arising from use of the Service shall not exceed the greater of (a) the amount you paid us in the 30 days preceding the claim, or (b) USD $50 — whichever is lower.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, our liability is limited to the fullest extent permitted by law.

9. Indemnification

You agree to defend, indemnify, and hold harmless AI Growth Engine and its owners, employees, contractors, and affiliates from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content or URLs you submit through the Service.

10. Payments and Refunds

The free audit tool is provided at no cost. Where paid services, fix plans, or implementation packages are purchased:

• All sales are final unless otherwise stated in writing at the time of purchase
• Refunds may be considered within 7 days of purchase if no work has commenced, at our sole discretion
• We do not issue refunds based on dissatisfaction with audit results, score outcomes, or recommendation accuracy
• Chargebacks or disputes filed without prior contact will result in immediate termination of access and may result in further action

11. Intellectual Property

All content, design, code, branding, reports, and materials on the Service are the property of AI Growth Engine or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our express written permission. Audit reports generated for your own website may be used internally by you, but may not be resold or redistributed.

12. Privacy & cookies

Your use of the Service is governed by our Privacy Policy and Cookie Policy, each incorporated into these Terms by reference. By using the Service, you acknowledge our data practices described there—including that we do not sell your personal information as described in the Privacy Policy.

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, and without liability to you. We may also change pricing, features, or availability at our discretion.

14. Governing Law and Disputes

These Terms are governed by the laws of the United States. Any dispute arising out of or relating to these Terms or the Service shall be resolved as follows:

• You agree to first contact us at hello@aigrowthengine.com and attempt to resolve the dispute informally within 30 days
• If unresolved, disputes shall be settled by binding individual arbitration under the rules of the American Arbitration Association — not in court and not as a class action
• You waive any right to participate in a class action lawsuit or class-wide arbitration against AI Growth Engine

If a court or arbitrator holds that arbitration or class-action waiver requirements cannot apply to you under mandatory law in your jurisdiction, those requirements apply only to the minimum extent required.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and AI Growth Engine regarding your use of the Service and supersede all prior understandings or agreements on the subject.
